 Definitions

  1. Communication by e-mail: When in the text of these Terms & Conditions communication by e-mail is stated, Inspiring Mountains uses the info@inspiringmountains.com mail address.
  2. Customer: Every individual that is interested in or registers for the services offered by Inspiring Mountains
  3. Group activities: Services that are offered as a single event  for which several people can register.
  4. Intake process: For admittance into a service, a service related intake form is sent to the registered person. This process is intended to verify whether there is a good match between the Registered Person and the service offered  by Inspiring Mountains.
  5. Participant: The person admitted into and participating in a Service.
  6. Practitioner: A trained therapist, mental or physical health professional (doctor, psychologist or psychiatrist).
  7. Registered Person: A person that has filled out the service related registration form, has accepted these terms & conditions and with whom registration is confirmed by e-mail from info@inspiringmountains.com.
  8. Services: Services are understood to mean all activities offered by Inspiring Mountains on www.inpringmountains.com including (and therefore not limited to) workshops, trainings, retreats or coaching.
  9. You: The word Customer, Participant and “you” are interchangeably used in these Terms & Conditions.

About these Terms and Conditions

  1. The Terms and Conditions are intended to provide clarity about agreements between Customer and Inspiring Mountains.
  2. Each version of the Terms and Conditions is identified by a version number and date on which they where published on the website of Inspiring Mountains.
  3. These Terms and Conditions can be updated from time to time.
  4. By registering to Inspiring Mountains for a Service you are agreeing and accepting our Terms and Conditions.

About Services provided through Inspiring Mountains

  1. Services offered by Inspiring Mountains are not  a replacement for therapy, a psychological or physical treatment that a Customer receives from a Practitioner.
  2. The Trainer/Coaches who are delivering Services are trained and certified in their field of expertise. A description of their expertise can be found in their individual profile on www.inspiringmountains.com 
  3. In the case of a group training and when applicable for a Service, the minimum and/or maximum number of participants will be stated.
  4. When stated, a Service will be delivered when the minimum number of registrations has been met.
  5. In case of insufficient registrations for a group training, Inspiring Mountains reserves the right to cancel it
  6. It is the responsibility of the Customer to disclose any critical information that can prohibit participation.

    Registration and Participation

    1. A Customer registers through the website www.inspiringmountains.com for a Service by completing the service-related registration form. The registration is completed when a participant has received a confirmation e-mail.
    2. Admittance in the group training is done in order of registration and after having completed the intake process and having paid in full.
    3. Inspiring Mountains has the right to refuse participation of a registered Customer in a service or further access to the services, if the Customer may run a health risk according to the Trainer/Coach. or the Customer has not fulfilled the payment obligations in full.

    Intake process

    1. After registration, the participant will receive an intake form with the request to complete it truthfully and return it by e-mail as soon as possible. 
    2. When the intake form is returned, the Trainer / Coach contacts the participant for an interview,
    3. It is the responsibility of the customer to share information during the intake process that may pose a risk of participation.
    4. The interview is done to clarify mutual expectations and to verify whether there is a good match between the participants needs and the Service.
    5. When admitted, participation is definitive and confirmed by e-mail.

    Responsibility of a Participant and Trainer / Coach

    1. When participating in a Service, participation is at your own risk and the decisions you make are solely your responsibility.
    2. The participant is solely responsible for the management, loss or damages of personal property during the training.
    3. The Participant should respect their own limits and is always responsible for the choice and manner of participating in exercises during the training, and possible consequences for his / her health. As a result, Inspiring Mountains nor the Trainer/Coach can be held responsible for any damage resulting from this.
    4. If you as a participant during a Service or as a result of participating in a Service, suffer any emotional or physical distress or harm, it is expected that you inform the trainer/coach as soon as possible. The Trainer/coach will discuss a way to go forward.
    5. As part of his/her responsibility for your wellbeing, the Trainer/Coach can decide that you discontinue your participation in a training.

    Limitation of Liability

    1. Inspiring Mountains shall not be responsible for any loss that a participant suffers as a result of participating in a Service, except for those losses which it could reasonably be foreseen.
    2. The participant is solely responsible for the management, loss or damages of personal property during the training.
    3. The participant agrees that any claim against Inspiring Mountains or any teacher, trainer, practitioner, employee or agent of Inspiring Mountains within 60 days of the event that give rise to such claim.
    4. The participant acknowledges warrants and undertakes the maximum aggregate liability of Inspiring Mountains shall not exceed the Fee paid for the Service.

    Cancellation and refund policy

    When the Participant wants to cancel the participation in the Service, the cancellation must be made known to Inspiring Mountains by e-mail before the start of a Service. Inspirational Mountains uses the following refund policy:

    Refundable

    1. 100% refund when cancellation is made known 14 days prior to the start of the training
    2. 50% refund when cancellation is made known less than 7 days prior to the start of the Service
    3. In case the Trainer / Coach, as part of his/hers responsibility for your well being, decides you should discontinue participation in the training, a partial refund equivalent to the outstanding period of the training will be made.
    4. If the Trainer is not able to deliver the Service, the Trainer will arrange for a replacement. If that is not possible, the Trainer will make alternative dates available in which the training / workshop / event can be completed. In case it  is not possible to resolve the situation other than through cancellation, the Service fee will be 100% refunded.

    Non-refundable

    1. If a participant fails to attend or a participant cancels his/her participation on the day of the start of the course. In this case, the full course fee will be non- refundable.
    2. If a participant misses a training session, or if the participant decides or is not able to continue the course.
    3. If a participant missed parts of a Training /  Workshop / Event.
    4. If a coachee fails to inform the Coach 24 hours in advance of the session, the coachee will be billed for a session, unless due to sudden illness or emergency.

    Data protection

    1. Inspiring Mountains act as a Data Controller in relation to Services supplied under these Terms and Conditions and has a specific person named responsible for data as is stated in our Privacy statement. Inspiring Mountains will adhere to all applicable data protection laws and always stores data sent to us in a secure manner as outlined in our Privacy statement.
    2. Inspiring Mountains shall ensure that data processing only takes place in accordance with the Terms and Conditions and any Data Processing agreements as outlined in the Privacy statement.
